$70,000 Settlement for Grandmother Rear-Ended in Crash

On September 11, 2019, our Plaintiff, who was at the time 56 years old, was rear-ended while driving her car and yielding to a pedestrian as they crossed an intersection on Market Street in Newark, New Jersey. Due to her immediate onset of neck and back pain, she was taken to St. Barnabas Medical Center’s Emergency room. She continued to get treatment from a chiropractor for continued pain and physical limitations.

Lazaro Berenguer, Esq., of Clark Law Firm, PC., filed the case in Essex County in September 2020; under Docket Number: ESX-L-6257-20. Throughout this hard-fought litigation the Defendant not only blamed the Plaintiff for the crash, but through its orthopedic medical expert, said that she did not sustain any injury because of the crash, but that her pain was due to her old age. However, the Plaintiff’s orthopedic medical expert and radiologist concluded that she did in fact sustain a permanent injury to her spine because of the crash.

Due to the successful and persuasive presentation of this case, Lazaro Berenguer, Esq., settled this matter for $70,000 ($20,000 over the arbitration award).
