Client Recovers Settlement on Eve of Trial Following Serious Thumb Injury

Our client was injured on November 4, 2015 when she fell on the sidewalk outside her doctor’s office. She fell to the ground due to a section of loose and raised cement, causing her to break her nose and dislocate her thumb, which was already painful from pre-existing arthritis.

Her nose injury healed on its own, however, three months after her fall, she underwent a right thumb basal joint arthroplasty and fusion of her MP joint.  Defendant’s doctors blamed the need for this surgery on her pre-existing arthritis.  Our client’s doctors opined the thumb injury was caused by her fall and at the least accelerated her pre-existing arthritis, thus necessitating the need for surgery.  Two years following her fall, she passed away due to unrelated causes and her Estate continued on with her case.

The case settled on the eve of trial for $45,000.
