Attorneys for Yaz and Yasmin Contraceptive Drug Medication; Consumer Lawyers for Defective Drug Cases

According to litigation documents, Bayer Healthcare Pharmaceuticals (Bayer), the company responsible for manufacturing commonly used contraceptives, Yaz and Yasmin, since as early as 2001, has allegedly undercut consumer expectations and safety standards by using numerous deceptive practices in order to market their products and increase their profits at the expense of consumer’s health.

First, upon information and belief, Bayer’s market research findings that women were purchasing a competitor’s product to treat mood swings related to Premenstrual Syndrome (PMS) and the more severe Premenstrual Dysmorphic Disorder (PMDD), Bayer began a market campaign in which they claimed their products, Yaz and Yasmin, were effective remedies for the symptoms of PMS, as well as the treatment of moderate forms of acne.

Realizing consumers were being greatly misled by these deceptive practices, the FDA quickly stepped in, mandating Bayer to run $20 million worth of correct advertisements.  The damage, however, had already been done, as misinformed consumers were purchasing $2 billion worth of Yaz and Yasmin each year, thus making this sanction a light slap on the wrist for a mega corporation.

Using this allegedly fraudulently amassed collateral, Bayer set off on a campaign to discredit substantial scientific findings that Yaz and Yasmin placed its users at a heightened risk of Venus Thromboembolism (VTE), which involves blood clots forming in one’s veins, and Pulmonary Embolism (PE), a life threatening form of blood clotting which blocks the flow of blood, usually to one’s lungs.  It is alleged that rather than correct the harmful side effects of Yaz and Yasmin, Bayer chose instead to cloud accredited scientific research condemning their products with scientific research financed and conducted by their own handpicked set of researchers.

The death toll for Yaz and Yasmin should have wrung upon the FDA’s findings that consumers of this contraceptive were placed at a two to three times greater risk of VTE than consumers of other contraceptives offering the same benefits.  Similarly, 11 out of 26 doctors found that the benefits offered by the key ingredient in Yaz and Yasmin did not outweigh the harm and risk it created for consumers.   However, despite these findings, Bayer continues to produce this dangerous pill, needlessly placing consumers at risk, and ignoring scientific outcry.
