“Pissy” Contractors Pay $1.2 Million for Mom’s Mold Exposure Injuries

In 2019 a young couple with two young children purchased a new townhouse from a large developer in Cape May Courthouse, New Jersey. The townhome turned out to be defective. Among other things, the master bathroom was defectively installed such that water leaked behind the shower into the wall space. This and other defects caused a really bad black mold and ant infestation problem (ants are attracted to water) which the mom was exposed to in her home for over 24 months. The construction was so poor that the builder had to have the shower ripped out and replaced twice. The contractor that had to redo their work apparently got “pissy” and out of spite left a 22-ounce WAWA cup filled with urine right beside a fully functioning toilet in their master bathroom.

That, combined with incessant cleaning and air filtering, reduced the mold levels by testing done about 5 months after the remediation, but by then the permanent human damage had already been done and the mold level later increased due to other construction defect issues. This young mom and wife suffered permanent pulmonary and autoimmune injury from this toxic mold, water and insect contamination.
Clark Law Firm filed a lawsuit for the couple in Middlesex County Superior Court in 2020. The case was fought tooth and nail by the defendant home builders for nearly four years. Clark Law Firm was successful in settling the matter against the defendant contractors for a total recovery of $1.2 million.
