When safety rules are broken, everyone is at risk. No one can put a corporation in jail. But a motivated jury can take the profit out of breaking the rules and endangering the public. As voices of the community, jurors are empowered to hold wrongdoers accountable. Jury trials for personal injury and accident victims in New Jersey usually happen because insurance companies are unwilling to pay fair compensation.

The following are some of our trial verdicts and settlements. Our best New Jersey injury lawyers are happy to have a jury decide what is fair compensation.

Update on Pro Bono Emergent Appeal on Behalf of Manasquan Basketball Team- Appellate Division Decision

Clark Law Firm Statement on the Appellate Result

Manasquan Basketball- Appellate Division decision

Appellate Division Makes Final Decision on Pro Bono Action for Manasquan Boy’s High School Varsity Basketball Team – March 8, 2024

The New Jersey Superior Court, Appellate Division issued its final ruling at 7:00 pm on Friday, March 8.

The Court declined to intervene in the matter and the championship game will be played on Saturday, March 9 between Camden High School and Arts High School.  Attorney Gerald Clark of the Clark Law Firm, who served as pro bono counsel for the Manasquan team, commented,  “We disagree with the decision of the Court and maintain under these unusual circumstances, NJSIAA violated its own rules in not advancing the actual winning team to the finals.  However, we fully respect the decision.  Judge  Marczyk who issued the opinion is an excellent and fair jurist.”  Clark further commented, “Manasquan is one of the top Districts in the State and its Superintendent and Board Members are a class act.  It has been a pleasure advocating for their kids.”

Attorney Jake Antonaccio, also of the Clark Law Firm who worked on the matter commented, “This was a hard-fought battle, but not as hard as the boys on Camden and Manasquan played in the semifinal game.  We wish Camden and Arts High School the best of luck in the finals.”

Clark concluded by saying, “Sports and litigation are very similar.  It is important to be humble in victory and gracious in defeat.  A takeaway lesson here for the kids is that life is not always fair, the best team does not always win, and sometimes the winning team does not advance to the next round.  The boys should know this is all the more reason to always stand up for what is right, fight for justice within the rules of our system, and never lose the integrity, class and respect you have shown throughout this ordeal.  These kinds of things make you stronger and will prepare you for life’s challenges.  Go Big Blue!”

Clark Law Firm Files Pro Bono Action on Behalf of the Manasquan Boys High School Varsity Basketball Team

View the Official Press Release Here >

March 6, 2024 – Clark Law Firm, PC, Belmar, New Jersey has been retained by the Manasquan Board of Education to file an Order to Show Cause on behalf of the Manasquan Boys Basketball Team in connection with the New Jersey State Group 2 semifinal championship game which took place on March 5, 2024 at Central Regional High School in Bayville, New Jersey.  The legal action seeks to temporarily enjoin the New Jersey State Interscholastic Athletic Association (“NJSIAA”) from conducting the Boy’s Varsity Group 2 State Championship Game currently scheduled to take place this Saturday, March 9, 2024 between Camden High School and Arts High School (Newark), until the New Jersey Superior Court, Chancery Division has a chance to pass on the issue.

The action asserts that on March 5, Manasquan High School played Camden High School in the semifinal game.  Manasquan won the game on a buzzer beater, 47 to 46.  The official with the clearest view properly called the shot good, the game concluded, and at least two of the three game officials left the court.  Thereafter, the referees came back onto the court, with one referee apparently overturning the referee who got the call right.  The basket was declared no good for time expiring and Camden High School was incorrectly declared the winner, 46-45.

The next day, on March 6, game officials and the NJSIAA released written statements that the original call was correct, expressing regret,  but refusing to officially declare Manasquan High School the winner and clear them to move onto the championship game.

Attorney Gerald Clark, the Principal of the Clark Law Firm, commented, “Everyone recognizes and the video shows the original call was right.  The correct call was made, the game was over and officials had left the court, only to return to overturn the correct call.  The  NJSIAA should follow its own rules under these circumstances and declare Manasquan the rightful winner.”

Clark further commented, “We have not seen anything to suggest any foul play nor ill will by anyone in this matter and it is important to recognize neither the coaches, players, nor fans on either side had anything to do with this incorrect call and referees make mistakes like everyone else.  However, NJSIAA has the authority to make this right and it is our position they should follow their own rules and do so.  They should forthwith declare Manasquan the official winner and clear them to play Arts High School in the championship game.”

How Do I Know If I Have a Valid Personal Injury Claim in New Jersey?

Have you been injured and are wondering if you have a valid personal injury claim in New Jersey?  If you have been injured in the Garden State because of someone else’s negligence or wrongdoing, you may be able to file a personal injury claim. However, many different factors go into determining if you have a valid injury claim.

What is the Criteria for a Valid Personal Injury Claim in New Jersey?

One aspect that goes into this criteria is called “Duty of Care.” Duty of Care refers to the concept that a person or business has a legal obligation to act in a way that would prevent others from getting harmed.  An example of this could be that Turnpike drivers have a responsibility to follow traffic signs and laws to avoid causing accidents.  Another example could be that a business owner is responsible for keeping the entrance to their business clear of ice, snow, or any other obstructions that may cause a person to have a slip-and-fall accident.

Next, the aspect of “Breach of Duty” comes into play.  Breach of Duty comes after “Duty of Care” has been established. In this sense, a person would have to prove that the negligent party breached their duty by acting with poor judgment or were negligent in their actions or behavior.  One example could be that a driver failed to stop at a stop sign and as a result caused an accident that injured other drivers and/or pedestrians. Another example could be a grocery store not cleaning up a spill in an aisle in a timely manner.

How Do I know If I Have a Valid Personal Injury Claim in New Jersey

Causation Must Be Proved By Linking The Person’s Negligence With Your Injury or Harm

The concept of “Causation” means that a person or business’s actions are in direct correlation with your injuries.  Just because someone acted negligently is not enough; there must be a clear link between their actions and your injuries.

Did You Suffer Damages As a Result of Your Injuries in New Jersey?

If you were injured in NJ and lost wages and had medical bills as a result of your injuries and incurred pain and suffering, then this is also the criteria for a valid personal injury claim in New Jersey.

What is Comparative Negligence in New Jersey?

Comparative negligence refers to the concept that if you were partially at fault for your accident or injury; then your compensation may be reduced determined by your percentage of fault.

If your fault is still less than 50%, then you may still be able to recover damages for your injuries.  It is best to consult a knowledgeable personal injury law firm that can evaluate the distinct circumstances of your situation.  Call Clark Law Firm P.C. today if you have questions about your personal injury claim at 1-877-841-8855.

How to Choose the Best Personal Injury Lawyer in Essex County, New Jersey

If you have been injured in New Jersey or Essex County it is imperative to find the right injury lawyer for your case. Finding the best personal injury lawyer in Essex County for your case may require some research, scheduling a consultation with a couple of firms and looking at their reviews. Keep in mind that while one firm may not accept your case, another injury firm may accept your case.  Each NJ injury firm is different, and it is about finding the right fit for your needs. If you’re confused about finding the right personal injury lawyer for your injury claim, contact Clark Law Firm at 1-877-841-8855 with any questions.

How to Choose the Best Personal Injury Lawyer in Essex County, New Jersey

Look for a New Jersey Personal Injury Law Firm that Understands What Your Specific Needs Are

For example, if you were injured in a construction site accident at work, it is important to find a personal injury lawyer who has experience handling those types of cases. There are hundreds of personal injury lawyers but not all of them specialize in the same practice area niches.

Even though they may list all practice areas of personal injury law, it is important to gauge their experience in the niche that your case may fall in. Furthermore, if you require a bilingual lawyer who speaks Spanish or Portuguese, it is important to ask the firm if they have bilingual lawyers.

Ask the Right Questions Before Choosing the Best Personal Injury Attorney For Your Case

Just as a lawyer may be evaluating your case to see if it is something they can accept; you can also do your due diligence by asking them the right questions. One of the questions you can ask them is do they have experience handling cases with the type of injuries that you incurred. You should also ask them what their process is for working with a new client and what information they will need from you. The more prepared you are to provide them with all documentation and details of your potential case, the better they can assist you.

What Experience Does Your Personal Injury Lawyer Have in Similar Types of Cases

Does the law firm you’re thinking of retaining in New Jersey have the experience and bandwidth to handle your case? Are they the type of firm that is more of a mill and takes every case that they get and farms it out to other attorneys or are they more selective and only take cases that they feel they can best represent?

At Clark Law Firm P.C., we do not accept every case but the cases we do take we make sure that we go the extra mile to do our due diligence. We believe in best representing our clients by selecting cases that have strong facts and we utilize our resources to build a strong case.

Is Your Essex County Personal Injury Lawyer Prepared to Go to Trial?

In many personal injury cases, a settlement cannot be finalized with the insurance provider because the insurance company may be undervaluing the severity of the injury and trying to payout compensation that is way lower than may be justified. This is when your Essex County personal injury lawyer may recommend that they take your case to trial.

Taking and case your trial may not be the quick and easy way to get a settlement; however, it is the best way to ensure that you’re getting the fairest outcome based on the evidence presented in the trial.

Why Choose Clark Law Firm P.C. as Your Essex County Injury Lawyers

At Clark Law Firm, P.C., we have years of experience taking cases to trial and getting justice for our injured clients. Is Your Injury Lawyer Prepared to Fight for You in New Jersey?

That means that your injury lawyer is willing to go above and beyond to do what it takes to gather the right evidence, interview the appropriate witnesses, and go up against the defense and their expert witnesses with a solid game plan.

It’s about finding the loophole or taking the time to read an entire book to get a better understanding of how an accident may have happened and what may have caused it. It’s about doing what it takes to get justice for client’s injuries and ensure that they get compensated for their pain and suffering and loss of quality of life.
